Liability insurance

At Lynk, we consider the quality and reliability of our services to be the bedrock of our client relationships. While our Cybersecurity insurance defends against digital threats, we maintain a robust Professional and General Liability policy to provide a comprehensive safety net for our professional advice and daily operations. This coverage, managed through Aon and underwritten by Hiscox SA, ensures we are financially prepared to address operational risks or professional errors.
1. Professional indemnity: defense for expertise
Our professional indemnity coverage is specifically tailored for our role as an ICT service provider. It protects our systems—and your interests—against claims arising from our professional services, including software development, system management, and strategic project planning.
Professional Liability (Per Claim): €2,500,000.00.
Professional Liability (Annual Max): €5,000,000.00.
Negligence & Errors: Coverage for damages resulting from mistakes, errors, or a breach of duty to exercise reasonable care and skill during our business activities.
Intellectual Property: Protection against claims of unintended infringement of copyrights, trademarks, or trade secrets.
Data & Document Integrity: Coverage for the loss, damage, or destruction of third-party documents or data for which we are responsible.
2. General liability: operational risk management
Beyond our professional advice, we maintain high coverage limits for physical or material damages occurring during our standard business operations.
General Liability (Per Claim): €5,000,000.00.
General Liability (Annual Max): €10,000,000.00.
Care, Custody & Control: Specific coverage of €125,000.00 per year for damage to third-party items currently under our care or supervision for ICT purposes.
Visitor Protection: Coverage for personal injury claims made by visitors (such as clients or suppliers) to our premises, even in instances where Lynk may not be strictly legally liable.
3. Comprehensive specialized coverage
Our policy includes several specialized sub-limits to ensure continuity and stability in complex scenarios:
Reputation Damage: Up to €100,000.00 to cover costs for restoring our professional reputation following a covered incident.
Key Person Coverage: Protection for financial losses resulting from the sudden loss of employees in critical "key" positions.
Employee Dishonesty: Coverage for direct financial losses caused by fraudulent or dishonest acts by our own personnel.
Legal Defense: Full coverage for legal costs and criminal defense fees related to professional claims.
4. Policy terms & global scope
Worldwide Coverage: Our protection is active globally, excluding the U.S. and Canada (though coverage applies to these regions for standard business travel).
Retroactive Peace of Mind: We maintain a retroactive period that covers claims arising from acts or omissions that occurred before the policy's start date, provided a continuous previous insurance was in place.
Legal Framework: We strive to use NLdigital or similar industry-standard terms in our agreements to ensure a clear and professional legal framework for all parties.
Dispute Resolution: We adhere to the Dutch Financial Services Complaints Tribunal (Kifid) and Dutch law for transparent and fair handling of any disputes.
